Terms of use

Plain.ninja Platform · PLAIN APP, S.L.

1. Preliminary provisions

PLAIN.NINJA is a platform designed for time management in SMEs and large companies, including employee time tracking, absence management, holiday management and approval, shift planning and prediction of operational needs, among other features. This platform has been developed by PLAIN APP, S.L. (hereinafter, "PLAIN APP" or "OWNER").

This document establishes the clauses governing the General Terms of Use of the "PLAIN.NINJA" platform ("GTU"), available through the website plain.ninja.

The GTU are complementary to the Legal Notice, the Privacy Policy and the Cookie Policy. For any queries: [email protected].

3. User

Accessing, browsing, registering or using the platform grants the visitor USER status. The USER declares:

  • Being of legal age and/or having the capacity to enter into contracts.
  • Having read, understood and fully accepted these GTU.

4. Acceptance

The GTU constitute a binding contract. By accepting them via the corresponding checkbox, the USER is bound by these GTU. Continued use of the platform implies acceptance of any modifications. If the USER does not accept the GTU, they must refrain from using PLAIN.NINJA.

These conditions may be modified at any time. It is the USER's responsibility to read them periodically. They can be consulted at: https://plain.ninja/terms-of-use/

5. Definitions

  • PLATFORM — "PLAIN.NINJA" as described in section 6.
  • OWNER AND CONTROLLER — PLAIN APP, S.L.
  • USER — The client (natural or legal person) who contracts the use of PLAIN.NINJA.
  • AUTHORISED EMPLOYEE — A natural person authorised and employed by the USER to use PLAIN.NINJA.
  • USE — Accessing, loading, executing, employing, using, storing or viewing the platform, directly or indirectly.
  • MODIFICATION — A change to the platform that involves an alteration to its source code.
  • THIRD PARTIES — Persons other than the OWNER, the USER and the AUTHORISED EMPLOYEE.

6. Service description and platform operation

Services provided include:

  • Employee time tracking
  • Employee absence management
  • Holiday management and approval
  • Employee shift planning
  • Automatic shift planning via computer algorithms
  • Prediction of operational needs via computer algorithms
  • Employee document management

Free trial version: 15 calendar days, with restricted features. Registration required.

Paid versions (BASIC / PRO): With full or expanded access to all features depending on the contracted plan (AI scheduling, payroll distribution, digital signature, API access, terminal integration, etc., available in PRO only).

Pricing:

  • BASIC: €2.50/employee/month (€30 + VAT/employee/year)
  • PRO: €4/employee/month (€48 + VAT/employee/year)

Registration: The USER must provide name, company, email and password, and accept the GTU and Privacy Policy.

Account: Unique, personal and non-transferable. The USER must immediately notify the OWNER of any unauthorised access. The account can be cancelled at [email protected].

Authorised employees: The USER controls the onboarding and offboarding of AUTHORISED EMPLOYEES. Exceeding agreed limits may result in automatic account cancellation.

7. Licence to use

Upon acceptance and payment, the OWNER grants the USER a personal, limited, revocable, non-transferable and non-exclusive licence to use the platform. This licence does not constitute a sale.

The licence terminates due to:

  • Non-renewal after one year.
  • Expiry of the agreed service period.
  • Non-payment.
  • Cancellation or termination by the OWNER.

8. Price and payment method

Payment is annual and in advance, with a grace period of up to 5 days after the renewal date. Non-payment results in automatic service cancellation and access blocking.

Payment methods: credit card, direct debit or bank transfer.

Non-renewal must be notified at least 60 days in advance of the renewal date.

9. User-submitted content

The USER may introduce information and content into the platform. The USER guarantees having all the necessary rights and authorisations to do so, in accordance with applicable legislation.

10. Owner's obligations

  • Ensure the correct operation of the contracted platform.
  • Inform the USER of the required hardware and equipment configuration.
  • Keep the platform updated and notify the USER of changes.
  • Preserve and safeguard the USER's account information with due diligence.

11. User obligations and prohibitions

The USER or AUTHORISED EMPLOYEE must:

  • Use the platform in accordance with the law and public order.
  • Not damage, disable, overload or impair the platform.
  • Not attempt to breach access levels, manipulate data, duplicate protected information, access restricted areas or introduce viruses.
  • Not reproduce the platform in whole or in part (except internal-use copies retaining copyright notices).
  • Not modify, alter or develop derivative works.
  • Not transfer rights to third parties, rent, lend, sell, distribute, sublicense or use the platform for unauthorised purposes.
  • Protect access against unauthorised use or disclosure to third parties.
  • Notify the OWNER of any defect within 5 days of becoming aware of it.
  • Not remove or disable the platform's security measures.
  • Not engage in reverse engineering, decompilation or disassembly.
  • Not create accounts on behalf of third parties or impersonate identities.
  • Not conduct vulnerability or security testing without prior authorisation from the OWNER.
  • Cooperate with the OWNER and comply with its recommendations.

12. Warranties

PLAIN.NINJA is provided "as is", with its defects and without warranties. Use is at the USER's own risk. The OWNER does not guarantee the viability of results (results are indicative only). The OWNER provides no warranty — implied or express — regarding uninterrupted operation, compatibility or error correction. No oral or written advice constitutes a warranty.

13. Liability

The OWNER is not liable for:

  • Interruptions caused by force majeure or circumstances beyond its control.
  • Damages resulting from the USER's inadequate hardware or USER's own infringements.
  • Personal injury, property damage, loss of profits, data loss, work stoppages or direct and indirect damages arising from the use of PLAIN.NINJA.
  • Loss of information, delays, processing errors or legal non-compliance by the USER.

The USER's sole remedy if dissatisfied is to stop using PLAIN.NINJA and terminate the service.

The USER is solely responsible for:

  • Backups of their data.
  • Correct installation of additional tools.
  • Maintenance of their equipment.
  • Power supply and integrity of their computer system.
  • Access control to prevent unauthorised use.
  • Hardware and software maintenance.
  • Antivirus and preventive measures.
  • Compatibility costs with other applications.

14. Service suspension

The service may be suspended if the USER fails to comply with the GTU or if account information is false. The OWNER will notify the USER in writing. If the USER does not resolve the situation within 30 days, the OWNER may suspend the service for as long as it deems necessary.

15. Termination

The licence terminates immediately and automatically if the USER breaches the GTU. The USER must stop using the platform and destroy all copies. Termination also applies if the OWNER considers that the use poses a security risk or involves illegal or improper use. Cancelled accounts require express authorisation to use the platform again.

16. Intellectual and industrial property

All intellectual and industrial property rights over PLAIN.NINJA (technology, software, source code, models, algorithms, derivative works, design, graphics and documentation) are the exclusive property of the OWNER. Reproduction, distribution, public communication, transformation or making available of PLAIN.NINJA or its content without express prior authorisation is prohibited.

Unauthorised use of intellectual property rights will give rise to the corresponding legal liability. The USER agrees to indemnify the OWNER for unauthorised or illegal conduct. To report infringements: [email protected].

17. Hardware and software requirements

The USER must have adequate computer equipment. Minimum requirements:

  1. Internet browser
  2. Email
  3. Computer security systems (firewall and antivirus)

The OWNER is not responsible for problems arising from the USER's defective or obsolete hardware.

19. Platform modification and updates

The OWNER reserves the right to modify PLAIN.NINJA unilaterally, at any time and without prior notice. Continued access implies acceptance of modifications. Support obligations for previous versions may end with the publication of updates.

20. Invalidity and ineffectiveness of clauses

If any clause is declared null and void or ineffective, only that specific provision will be affected. The remainder of the GTU will remain in force.

21. General provisions

  • Force majeure: Neither party shall be liable for non-performance resulting from riots, war, civil conflict, weather conditions, labour disputes, subcontractor failures or any cause beyond their reasonable control.
  • Assignment: The USER may not assign their obligations to third parties without the OWNER's written consent.
  • Notices: Notices shall be sent by email to the usual address of the receiving party.

22. Privacy policy and cookies

Personal data is processed in accordance with the Privacy Policy and the Cookie Policy.

23. Applicable law and jurisdiction

These GTU are governed by Spanish law. For dispute resolution, the parties submit to the Courts and Tribunals of Barcelona, unless applicable law mandatorily determines another jurisdiction.
